In Florida, private (non-DCF) adoptions are governed by Chapter 63 of the Florida Statutes.<\/p>\n<h3><strong><span style=\"color: #ff6600;\">Can I adopt my relative without an attorney in Florida?<\/span><\/strong><\/h3>\n<p>Yes. While there are many types of adoptions, the legal process for relative adoptions in Florida under Chapter 63 of Florida law was created to provide expedited and simplified family adoption procedures for adopting a child by relatives.\u00a0 The best part about this is that a Florida relative adoption can be economical, because you don\u2019t have to pay attorney\u2019s fees if you choose to do it <em>pro se<\/em> (without an attorney).\u00a0 But just because you decide to do it on your own doesn\u2019t mean that you have to do it alone.\u00a0 There are options available to help you achieve your relative adoption goal.<\/p>\n<h3><strong><span style=\"color: #ff6600;\">Who qualifies as a relative for the purposes of a Florida relative adoption?<\/span><\/strong><\/h3>\n<p>Florida Statutes, Section 63.032(16) states that a relative \u201cmeans a person related by blood to the person being adopted within the third degree of consanguinity&#8221;. \u00a0\u00a0This means that the child must be within the third degree of relationship to the adoptive parent. \u00a0The following chart provides a table of relationships used in Florida relative adoptions.<\/p>\n<p><img decoding=\"async\" class=\"wp-image-1360 alignleft\" src=\"https:\/\/floridadocument.com\/wp-content\/uploads\/2019\/01\/DegreeTable.png\" alt=\"Florida Relative Adoption Forms\" width=\"473\" height=\"460\" srcset=\"https:\/\/floridadocument.com\/wp-content\/uploads\/2019\/01\/DegreeTable.png 675w, https:\/\/floridadocument.com\/wp-content\/uploads\/2019\/01\/DegreeTable-300x292.png 300w\" sizes=\"(max-width: 473px) 100vw, 473px\" \/><\/p>\n<p>If you are a relative that falls outside of the third degree of blood relationship from the relative you wish to adopt, you will <strong>NOT<\/strong> be able to complete a Florida relative adoption without fulfilling additional requirements, <strong><u>and<\/u><\/strong> you will need an attorney to process the adoption.<\/p>\n<h4><\/h4>\n<h4><\/h4>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<h3><strong><span style=\"color: #ff6600;\">Do I need a home study for a relative adoption in Florida?<\/span><\/strong><\/h3>\n<p>No. \u00a0Generally, a Florida relative adoption under Chapter 63 does not require a home study, which makes it easier and more affordable for a relative to adopt in Florida.<\/p>\n<h3><strong><span style=\"color: #ff6600;\">Will the court process my relative adoption paperwork if I don\u2019t have an attorney?<\/span><\/strong><\/h3>\n<p>Yes.\u00a0 If your Florida relative adoption documents are properly prepared, signed and notarized, and you have paid the court filing fee (or obtained a waiver) the court must accept your pro se adoption case and process it.<\/p>\n<h3><strong><span style=\"color: #ff6600;\">Are Florida relative adoption forms available online?<\/span><\/strong><\/h3>\n<p>No.\u00a0 While you can find some (but not all) step-parent and adult adoption forms online, there are no Florida relative adoption forms available online for use by the public.<\/p>\n<h3><strong><span style=\"color: #ff6600;\">Can I use Florida stepparent adoption forms for my Florida relative or grandparent adoption?<\/span><\/strong><\/h3>\n<p>No.\u00a0 Although some clerks of court will suggest that you use stepparent adoption forms for your relative adoption (and modify them), you are being unintentionally set up for failure.\u00a0 Using improper adoption forms for adopting a family member in Florida case can have <a href=\"https:\/\/floridadocument.com\/a-customers-visit-to-the-law-library-for-adoption-forms\/\" target=\"_blank\" rel=\"noopener noreferrer\">disastrous consequences<\/a>, as these processes are different one from the other, and the wording and requirements for each of these adoptions varies significantly.<\/p>\n<h3><strong><span style=\"color: #ff6600;\">I can\u2019t afford an attorney.\u00a0 Where can I find help filling out the documents to adopt my relative in Florida?<\/span><\/strong><\/h3>\n<p>A Florida grandchild adoption or other Florida relative adoption is a life-changing event that should be carefully considered.
