Terms of Service for Mobile Notary Services

Welcome to Florida Document Specialists. By using our mobile notary services, you agree to the following terms and conditions. Please read them carefully before booking an appointment.

  1. Service Description

Florida Document Specialists provides professional mobile notary services within West Volusia County, including DeLand, Astor, Astor Park, De Leon Springs, Barberville, and Pearson. Our services include notarization of documents, witness provision (if available), and travel to client-designated locations, including homes, offices, hospitals, and public venues.

  1. Service Eligibility

You must be at least 18 years old and possess valid, government-issued identification to use our notary services. Acceptable forms of identification include but are not limited to:

  • State-issued driver’s license or ID card
  • Passport (Foreign passports must be stamped by USCIS.)
  • U.S. Military ID
  • Permanent Resident Card (Green Card)
  • Driver license or ID card issued by Canada or Mexico
  1. Scope of Notary Services

Our mobile notaries are authorized to:

  • Administer oaths and affirmations
  • Take acknowledgments
  • Witness or attest signatures
  • Certify or attest copies of documents

We do not provide legal advice or prepare legal documents unless explicitly licensed and authorized to do so.

  1. Mental Soundness of the Signer

It is the responsibility of the client to ensure that the signer is of sound mind and capable of understanding the nature and significance of the document being signed. Our notaries are required to assess whether the signer appears mentally competent at the time of notarization. If the notary determines that the signer is not acting of their own free will or lacks the mental capacity to comprehend the transaction, the notary may refuse to proceed with the notarization. A minimum fee will still apply.

  1. Fees and Payment
  • Notarization Fee: $10 per notarized signature, as permitted by Florida state law.
  • Travel Fee: Starting at $45 for locations within our service area.
  • After-Hours Surcharge: Appointments scheduled after 9:00 PM will incur a $60 surcharge.
  • Witness Fee: $50 per witness, if available.

Payment is due at the time of service. We accept credit/debit cards or cash.

  1. Appointment Scheduling and Cancellations
  • Appointments can be scheduled by phone or through our website.
  • If a notary arrives at the scheduled location and the appointment cannot proceed due to the client’s failure to provide proper documentation or identification, a $45 minimum fee will still apply.
  • If the mobile notary deems the location to be unsafe or has concerns about safety, Florida Document Specialists reserves the right to refuse service. In such cases, a $45 minimum fee will still apply.
  1. Witness Provision

If your document requires witnesses and you are unable to provide them, we can arrange for witnesses at a fee of $50 per witness, subject to availability. Witnesses provided by Florida Document Specialists are present solely to witness the signing of documents and do not review or provide advice on the content of the documents.

  1. Client Responsibilities
  • Ensure that all documents to be notarized are complete and ready for signature.
  • Provide valid identification for all signers.
  • Inform us in advance of any special requirements, such as additional witnesses or specific signing instructions.
  1. Limitation of Liability

Our notaries perform services in accordance with applicable state laws and regulations. While we take all reasonable precautions to ensure accurate and professional service, Florida Document Specialists is not liable for:

  • The legality or validity of the documents notarized.
  • Any issues arising from improperly prepared documents.
  • Any loss or damage resulting from the client’s failure to comply with these terms. Confidentiality

We respect your privacy and are committed to maintaining the confidentiality of all documents and information shared during the notarization process. Our notaries adhere to strict professional standards to ensure your personal information is protected.

  1. Force Majeure

Florida Document Specialists shall not be held liable for delays or failure to perform services due to circumstances beyond our control, including but not limited to natural disasters, accidents, government actions, or acts of God.

  1. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Volusia County, Florida.

  1. Amendments

We reserve the right to amend these Terms of Service at any time. Any changes will be posted on our website, and continued use of our services constitutes acceptance of the revised terms.
